Speaker Bio:

Jerry Mahun is a three-times retired surveying educator. His career started at UW-Platteville in 1979, then progressed through Purdue, Penn State University, and finally Madison Area Technical College after which he retired for the first time. Lasting only one year, he then taught part-time once again at UW-Platteville for six years before retiring a second time. After another short retired spell, he worked with NLCPrep.com as a Content Specialist for licensing exam review courses, consults with CSTLearn.com, and is an occasional Mentoring Mondays presenter. In addition to teaching Jerry has worked for the BLM, NGS, WisDOT, Wis Dept of Regulation and Licensing, and done consulting. He has presented diverse surveying workshops and seminars to a variety of different audiences since 1984. He maintains an Open Access Surveying Library at jerrymahun.com as a free surveying education resource. Jerry is a Wisconsin Professional Surveyor, and a member of the Wisconsin Society of Land Surveyors having served as a Director and on a number of its committees. 

Course Descriptions: 

Easements

Surveyors deal with easements all the time whether creating them on a plat or delineating them in a resurvey. An easement is the limited use of another’s land. Its use or purpose and physical extent should be defined since it encumbers the underlying fee. How an easement is created can affect how (or if) it can be removed, who enjoys the benefit, and who is impacted. We will examine common easement creation methods, responsibilities of the affected parties, prescription, abandonment, overburdening, as well interpretation issues. While there are some generally understood easement precepts and a few statutory provisions, most legal principles have been established through case law. These common law principals can vary considerably between states so we will concentrate on and cite Wisconsin cases.

Boundry Issues

After a brief refresher of the Rules of Construction, this session will concentrate on discussing specific boundary issues situations. Attendees are encouraged to submit a case they may have encountered and we will incorporate it into the discussion. No promise that we can absolutely resolve it, but maybe a few other perspectives and opinions can shed some additional light. While I can create cases for discussion, real ones that you have recently wrestled with add more dimension particularly considering the jurisdictional area you practice within.
